By downloading or using the app, these terms will automatically apply to the client - please make sure that you read them carefully before using the app. For the purposes of clarity the app user is referred to as 'client' in the terms below.
UKClimbing Limited is committed to ensuring that the app is as useful and efficient as possible. For that reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge for the app or its services without making it very clear exactly what is being paid for paying for.
The Client agrees to pay for all subscription fees, and hereby authorises UKClimbing Limited (and its payment processors) to debit Client's bank account or charge Client's credit/debit card, as stated on Client's channel subscription and billing page. Client agrees that all subscriptions are recurring and will renew automatically. Client agrees that a subscription is available to a single user for use on up to two separate devices.
The Client acknowledges that all subscription fees are charged automatically on a recurring basis until the Client cancels their channel subscription (both monthly and annual plans). Client may cancel their subscription by logging into their Rockfax Account Management page on rockfax.digital, going to subscription and billing and selecting the Cancel Subscription option. A confirmation email receipt is sent to the Client with the expiration date of the subscription with a single-click link to Manage Account where they can extend or cancel their subscription.
UKClimbing Limited is happy to offer refunds on subscriptions if you are not 100% satisfied with the product. Please contact us.
The Rockfax app stores and processes personal data that the client has provided to us in order to provide our Service. The Client agrees that it is their responsibility to keep their phone and access to the app secure. We recommend that the Client does not jailbreak or root their phone since this will compromise the phone's security and it could mean that the Rockfax app won't work properly or at all.
Certain functions of the app will require the app to have an active internet connection. UKClimbing Limited cannot take responsibility for the app not working at full functionality if you don't have access to Wi-Fi, and you don't have any of your data allowance left. If using the app outside of an area with Wi-Fi, the Client should remember that the terms of the agreement with any mobile network provider will still apply. The Client accepts responsibility for any such charges, including roaming data charges if using the app outside of your home territory.
UKClimbing Limited does not accept responsibility if the Client's device runs out of battery.
The inclusion of a climbing information in this app does not mean that the Client have a right of access or the right to climb upon it. The descriptions of routes within the app are recorded for historical reasons only and no reliance should be placed on the accuracy of the description. The grades set in this guide are a fair assessment of the difficulty of the climbs. A Client who attempts a route of a particular standard should use their own judgment as to whether they are proficient enough to tackle that route. Te app is not a substitute for experience and proper judgment. The authors, publisher and distributors of this book do not recognise any liability for injury or damage caused to, or by, climbers, third parties, or property arising from such persons seeking reliance on this app as an assurance for their own safety.
The Client agrees agrees to accept updates to the application when offered. Failure to do so may result in the app ceasing to work. UKClimbing reserves the right to stop providing the app and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using the app, and (if needed) delete it from your device.
The Client agrees not to copy, or modify the app, any part of the app, or our trademarks in any way. The Client agrees not to attempt to extract the source code of the app, to translate the app into other languages, or make derivative versions. The app itself, and all the trade marks, copyright, database rights and other intellectual property rights related to it, belong to UKClimbing Limited.
We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page. These changes are effective immediately after they are posted on this page.
